2. Acceptance of These Terms

You are legally capable of entering into a binding agreement.
The information you provide is accurate and complete.
You are submitting information for yourself or have authority to act for the other travelers identified in your submission.
You will use the website only for lawful and legitimate purposes.
You accept these Terms and our Privacy Policy.
If you submit information on behalf of another traveler, you are responsible for obtaining that traveler’s permission before providing their personal information.
3. Travel Inquiries and Partner Referrals

When you submit a travel inquiry, request a quote, enter a promotion, or otherwise express interest in travel, you authorize Holiday Travel to use and disclose the information you provide for purposes that may include:

Booking agreements.

Refund policies.
Payment requirements.
Travel-document requirements.
Licensing or registration information.
Customer-service procedures.
Holiday Travel does not control the day-to-day business practices, policies, actions, omissions, employees, contractors, or communications of independent travel providers.
You are responsible for reviewing and accepting the terms issued by the travel agency or supplier handling your reservation.
If another company is identified as the merchant, booking agency, ticket agent, fulfillment provider, or travel supplier, questions concerning the reservation should generally be directed to that company.
5. No Guarantee of Pricing or Availability
All travel information, availability, prices, promotions, amenities, itineraries, schedules, images, descriptions, and offers are subject to change without notice.
A price displayed, advertised, discussed, or quoted is not guaranteed until:
Availability has been confirmed.
All required traveler information has been provided.
Payment has been accepted.
The booking agency or supplier has issued a written confirmation.
Travel prices may change because of:
Supplier price changes.
Inventory changes.
Taxes.
Port charges.
Resort fees.
Fuel supplements.

Service fees.
Currency fluctuations.
Seasonal pricing.

Errors in pricing, availability, descriptions, or website content may be corrected at any time. We and the applicable travel provider reserve the right to cancel or decline a transaction based on an obvious pricing, typographical, technical, or inventory error.

A written reservation confirmation has been issued.
You are responsible for reviewing all confirmation documents promptly and notifying the applicable travel agency or provider immediately of any errors.

Dates of birth.

Destination.
Departure location.
Cruise ship or hotel.
Cabin or room category.
Flight information.
Number of travelers.
Amount paid.
Remaining balance.
Payment deadlines.
Cancellation terms.
Travel-document requirements.
Failure to report an error promptly may result in additional fees, loss of availability, denied boarding, cancellation, or an inability to make a correction.
8. Payments
Payments may be collected by Holiday Travel, a licensed travel agency, a travel supplier, a payment processor, or another authorized merchant.
By submitting payment information, you represent that:
You are authorized to use the payment method.
The payment information is accurate.
You authorize the applicable merchant to charge the disclosed amount.
You agree to any disclosed payment schedule.
You understand that separate transactions may appear from different travel providers.
A declined, reversed, disputed, or incomplete payment may result in cancellation of a request, reservation, promotion, or travel service.
You remain responsible for all authorized charges, applicable taxes, processing fees, cancellation penalties, chargeback fees where lawful, and other amounts identified in your purchase agreement.
You must not initiate an improper payment dispute or chargeback for a valid transaction. Before disputing a charge, you should contact the merchant identified on your receipt or billing statement and attempt to resolve the matter.
9. Cancellations, Changes, and Refunds
Cancellation, modification, and refund rights depend on the specific travel product and the policies of the applicable travel agency, supplier, carrier, hotel, cruise line, resort, tour operator, or other provider.
Travel products may be:
Refundable.
Partially refundable.
Nonrefundable.
Subject to cancellation penalties.
Subject to change fees.
Subject to supplier credits rather than cash refunds.
Transferable only under limited circumstances.
Nontransferable.
Subject to expiration dates.
Subject to forfeiture for failure to travel or meet a deadline.
You are responsible for reviewing the cancellation and refund policy before making a payment.
Unless a written agreement expressly states otherwise:
Submitting a website inquiry does not create a right to a refund.
Cancellation requests must be submitted to the company handling the reservation.
Failure to appear, board, check in, or travel may result in the loss of all amounts paid.
Changes may be treated as a cancellation and rebooking.
Processing, administrative, referral, membership, service, or consultation fees may be nonrefundable where disclosed and permitted by law.
Nothing in these Terms limits a refund or cancellation right that cannot legally be waived.
10. Travel Documents and Entry Requirements
You are solely responsible for obtaining and carrying all documents required for travel, including:

Birth certificates.
Parental consent documentation.
Health documentation.
Vaccination records.
Immigration documents.
Cruise boarding documents.
Airline tickets.
Hotel confirmations.
Other documentation required by a government, carrier, or supplier.
You are responsible for confirming that:
Your identification is valid through the required travel period.
The name on your reservation matches your identification.
You satisfy all destination entry and exit requirements.
You satisfy all cruise line, airline, hotel, or supplier requirements.
You are legally permitted to enter each destination.
You are eligible to return to your country of residence.
You have obtained required documents for all minors traveling with you.
Holiday Travel and independent travel providers are not responsible for denied boarding, denied entry, detention, deportation, missed travel, or financial loss resulting from insufficient, expired, inaccurate, or missing travel documents.
Travel requirements can change. You should independently verify current requirements with the relevant government authorities and travel suppliers before departure.
11. Health, Safety, and Accessibility
Travel involves inherent risks. Conditions at a destination may differ from those in your home location.
You are responsible for determining whether a trip is suitable based on your:
Health.
Mobility.
Medical needs.
Pregnancy.
Dietary needs.
Accessibility requirements.
Personal circumstances.
Risk tolerance.
You should consult an appropriate medical professional regarding health-related travel questions.
Requests for accessible accommodations, dietary arrangements, medical equipment, or other special assistance are subject to availability and supplier approval. Providing a request does not guarantee that it can be fulfilled.
Holiday Travel does not provide medical advice and does not guarantee the safety, accessibility, sanitation, political stability, or suitability of any destination or travel service.
12. Travel Insurance
Travel insurance may be available through an independent insurance provider.
Unless expressly included in writing, travel insurance is not automatically included with a travel purchase.
Travel insurance may provide coverage for certain events, subject to:
Policy limitations.
Exclusions.
Coverage amounts.
Eligibility requirements.
Filing deadlines.
Documentation requirements.
The insurer’s claim determination.
Holiday Travel does not guarantee that an insurance claim will be approved or paid.
You are responsible for reviewing the complete insurance policy and directing coverage questions to the insurer or licensed insurance representative.
13. Supplier Changes, Delays, and Cancellations
Travel providers may change or cancel:
Itineraries.
Departure times.
Arrival times.
Ports of call.
Flights.
Cruise ships.
Hotels.
Room or cabin assignments.
Transportation.
Tours.
Amenities.
Entertainment.
Dining.
Other travel components.
Such changes may occur because of weather, mechanical issues, operational decisions, government action, health emergencies, labor disputes, safety concerns, overbooking, insufficient participation, or circumstances beyond reasonable control.
Holiday Travel does not control independent travel suppliers and is not responsible for their actions or omissions.
Your rights following a supplier change or cancellation will be determined by applicable law and the policies of the company providing the affected travel service.
14. Promotions, Rewards, and Vacation Offers
Promotional travel offers may be subject to specific eligibility requirements, restrictions, fees, deadlines, and separate terms.
These may include:
Age requirements.
Residency requirements.
Household restrictions.
Attendance requirements.
Advance-notice requirements.
Blackout dates.
Limited inventory.
Seasonal restrictions.
Maximum or minimum occupancy.
Departure-location restrictions.
Travel-completion deadlines.
Taxes, port charges, resort fees, or other required charges.
Reservation or activation deadlines.
Restrictions on combining promotions.
Transfer restrictions.

Consumers may remain responsible for taxes, government charges, port expenses, booking fees, resort fees, transportation, gratuities, upgrades, and personal expenses.

15. Communications Consent
By providing your contact information and requesting information, you authorize Holiday Travel and applicable travel partners to contact you regarding your request, subject to the consent language presented on the form.

Travel quotes.

Follow-up communications.

USE OF OR INABILITY TO USE THE WEBSITE.
RELIANCE ON WEBSITE CONTENT.
TRAVEL INQUIRIES OR REFERRALS.
ACTIONS OR OMISSIONS OF INDEPENDENT TRAVEL PROVIDERS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLIDAY TRAVEL’S TOTAL LIABILITY FOR A CLAIM ARISING SOLELY FROM USE OF THE WEBSITE WILL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID DIRECTLY TO HOLIDAY TRAVEL FOR THE SPECIFIC WEBSITE SERVICE GIVING RISE TO THE CLAIM; OR
$100.00.
This limitation does not apply where liability cannot legally be limited, including any rights or remedies that applicable consumer-protection laws do not permit the parties to waive.
Separate liability terms may apply to a travel purchase under the contract issued by the booking agency or supplier.
25. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Holiday Travel and its owners, members, managers, officers, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from:
Your misuse of the website.
Your violation of these Terms.
False or unauthorized information submitted by you.
Your violation of another person’s rights.
Your unlawful conduct.
Your failure to obtain permission before submitting another traveler’s information.
This provision does not require you to indemnify Holiday Travel for conduct for which indemnification is prohibited by law.
26. Events Beyond Reasonable Control
Holiday Travel is not responsible for delay, interruption, failure, or loss caused by events beyond its reasonable control, including:
Severe weather.
Hurricanes.
Floods.
Fires.
Earthquakes.
Natural disasters.
Epidemics or pandemics.
War.
Terrorism.
Civil unrest.
Government orders.
Border closures.
Labor disputes.
Supplier insolvency.
Transportation interruptions.
Utility failures.
Internet outages.
Cyberattacks.
Equipment failures.
Acts or omissions of travel suppliers.
This section does not eliminate any nonwaivable right you may have under applicable law.
27. Informal Dispute Resolution
Before filing a lawsuit or arbitration demand, you and Holiday Travel agree to attempt to resolve the dispute informally.
You must send written notice containing:

Your email address and telephone number.
A description of the dispute.
Relevant reservation or reference numbers.
The relief requested.
Supporting documents.

The parties will have 30 days after receipt of the notice to attempt to resolve the dispute.
This informal-dispute requirement does not prevent either party from seeking emergency injunctive relief when necessary to prevent immediate harm.
28. Binding Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes that qualify for small-claims court or requests for emergency injunctive relief, any dispute arising from or relating to these Terms, the website, a travel inquiry, a referral, or communications from Holiday Travel will be resolved through individual binding arbitration rather than a trial in court.
The arbitration will be governed by the Federal Arbitration Act and administered by the American Arbitration Association under its applicable consumer arbitration rules.
The arbitration may be conducted:
By telephone.
By video conference.
Based on written submissions.
In person at a reasonably convenient location.
In another manner agreed upon by the parties.
The arbitrator may award the same individual remedies that a court could award, subject to these Terms and applicable law.
The arbitrator, rather than a court, will decide disputes concerning the interpretation, enforceability, or applicability of this arbitration agreement, except that a court may decide a dispute concerning the class-action waiver below.
Nothing in this section prevents either party from bringing an eligible individual claim in small-claims court.
29. Class-Action and Jury-Trial Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND HOLIDAY TRAVEL AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS.
NEITHER PARTY MAY BRING OR PARTICIPATE IN A:
CLASS ACTION.
COLLECTIVE ACTION.
CONSOLIDATED ACTION.
REPRESENTATIVE ACTION.
PRIVATE ATTORNEY GENERAL ACTION.
Unless both parties agree in writing, an arbitrator may not combine the claims of more than one person.
YOU AND HOLIDAY TRAVEL EACH WAIVE THE RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
If the class-action waiver is found unenforceable as to a particular claim, that claim must be decided by a court and not by an arbitrator.
30. Arbitration Opt-Out
You may opt out of the arbitration agreement and class-action waiver by sending written notice within 30 days after you first accept these Terms.
Your notice must include:

A clear statement that you are opting out of the arbitration agreement in the Holiday Travel Terms and Conditions.

Opting out of arbitration will not affect any other provision of these Terms.
31. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement.
For disputes not subject to arbitration, you consent to the jurisdiction of state or federal courts located in Delaware, unless applicable consumer law requires a different location.
Nothing in these Terms deprives you of a mandatory consumer protection provided by the law of your state of residence that cannot legally be waived.
32. Time Limit for Claims
To the extent permitted by law, any claim arising from the website or these Terms must be filed within one year after the claim arose.
A claim not filed within that period is permanently barred.
This provision does not apply where a shorter contractual limitations period is prohibited or where applicable law requires a longer period.
33. Electronic Communications and Signatures

39. Entire Agreement
These Terms, the Privacy Policy, and any additional written terms presented for a specific promotion, reservation, transaction, or travel product constitute the agreement applicable to your use of the website.
For a specific travel purchase, the booking agreement, supplier terms, confirmation, cancellation policy, and other transaction documents issued for that purchase may also apply.
If there is a conflict concerning a specific reservation, the more specific transaction document will control for that reservation, except where prohibited by law.
